How Much is a Claim Worth?

How Much is a Claim Worth? is a post from: http://www.personalinjurylawyercalgaryinc.ca/

Often, people ask me for advice on how much a person’s claim is worth upon our initial acquaintance. Typically, most will offer their opinion on what they think your claim is worth and often these opinions come from a source that is unseasoned or offers misinformation or both. This is why your primary care physician will be reluctant to offer a prognosis, which can be accurately depicted as what is yet to occur due to your injuries, until you have reached MMI (Maximum Medical Improvement).

Practically, you won’t achieve MMI until you have exhausted all feasible avenues where treating your injuries are concerned; treatments may include consulting specialists, taking medications as prescribed, facet joint injections, and chiropractic-related therapies or massage, and possibly even surgery. To properly evaluate your injuries, it is necessary to ensure you are at MMI. In addition, it’s necessary that your primary care physician and any additional healthcare providers extending you treatment are willing and equipped to offer you a prognosis. Usually, when a patient achieves MMI, I’ll advise that they should wait an extra three months prior to proceeding with any settlement negotiations to be positive that their condition is stable.

Next week, I will discuss three cases in which the Supreme Court of Canada put limits on damage amounts that can be claimed for pain and suffering in a personal injury case.
